Greek lawmakers approve contentious campus police legislation

The Greek Parliament passed contentious legislation on Thursday allowing for the creation of a campus police force and disciplinary council to end the tradition of violence at Greek universities. Many incidents of unrest have occurred at Greek universities, including a 1973 student revolt at Athens Polytechnic against the 1967–1974 military junta. Two British girls arrested for smuggling in Ghana

Two 16-year-old British girls were arrested in Accra, Ghana earlier this month for apparently attempting to smuggle £300,000 worth of cocaine in laptop bags.

Yasemin Vatansever, of Cypriot descent and Yatunde Diya of Nigerian descent were arrested as they attempted to board a British Airways flight from the Kotoka International Airport on July 2, 2007. The arrest was by the Ghanaian Narcotic Control Board. They were alleged to be carrying 6.5 kg of drugs. They are currently in Ghana police custody and have been visited by British High Commission staff.

The girls who are both students from Islington, north London, had left home after informing their families they were making a school trip to France. They are expected to be charged with “possessing narcotic drugs and attempting to export drugs”, for which they could be jailed for up to ten years if found guilty.

The arrest is part of the Operation Westbridge project set up in November 2006 as a collaboration between the Ghanaian Narcotic Control Board and HM Revenue and Customs of the UK. It is to curb the influx of drugs into Europe and the UK through West Africa which is now being used as a transit point from South America. The project involves the provision of technical and operational expertise to the Ghanaian teams and training in the use of specialist scanning equipment. Ghana is the first country in Africa to introduce such equipment.

David Cameron responds to rioting, promises changes on policing

British Prime Minister David Cameron has stated that a change in police strategy is appropriate following what many feel to be an inadequate response to the rioting that has overrun many cities across England. Riots started in Tottenham on Saturday night after the fatal shooting by police of Mark Duggan, a 29-year-old taxi driver who the Independent Police Complaints Commission state was in possession of a handgun, but did not fire it.

During the Parliamentary debate on the riots, David Milliband, the Labour leader, called on Cameron to reconsider cuts to police budgets. Chancellor of the Exchequer George Osborne described the communities where the rioting occurred as being “left behind” and “cut-off from the economic life-blood of the rest of the country”, and called for solutions to the “deep-seated social problems”

One avenue the Prime Minister is said to be considering is changing regulations on social media services like Twitter, Facebook and BlackBerry Messenger, the latter being used to communicate between groups of rioters. The Open Rights Group and Big Brother Watch came out in opposition to any plans to restrict communication using social media, with Jim Killock of the Open Rights Group warning that such regulation would be abused by the police and private companies.

In Southampton, England, three people were arrested by police for the suspicion of using Twitter or BlackBerry Messenger to encourage the rioting. The government is “working with the police, the intelligence services and industry to look at whether it would be right to stop people communicating via these Web sites and services when we know they are plotting violence, disorder and criminality,” said Cameron.

The Prime Minister also announced that he would consider using the army to support the police in controlling future rioting, and also that he would consult with William J. Bratton, CBE, who had been the chief of police in Los Angeles and a police commissioner in New York City and Boston. Bratton is quoted as saying that arrests are not the only way to solve societal problems which lead to rioting and unrest: “You can’t arrest your way out of the problem.”

The announcement caused an impassioned discussion about the civil rights leader’s work, the problems facing the black community and whether Sharpton helps or hurts his cause. Gastric bypass surgery performed by remote control

A robotic system at Stanford Medical Center was used to perform a laparoscopic gastric bypass surgery successfully with a theoretically similar rate of complications to that seen in standard operations. However, as there were only 10 people in the experimental group (and another 10 in the control group), this is not a statistically significant sample.

If this surgical procedure is as successful in large-scale studies, it may lead the way for the use of robotic surgery in even more delicate procedures, such as heart surgery. Note that this is not a fully automated system, as a human doctor controls the operation via remote control. Laparoscopic gastric bypass surgery is a treatment for obesity.

There were concerns that doctors, in the future, might only be trained in the remote control procedure. Ronald G. Latimer, M.D., of Santa Barbara, CA, warned “The fact that surgeons may have to open the patient or might actually need to revert to standard laparoscopic techniques demands that this basic training be a requirement before a robot is purchased. Robots do malfunction, so a backup system is imperative. We should not be seduced to buy this instrument to train surgeons if they are not able to do the primary operations themselves.”

There are precedents for just such a problem occurring. A previous “new technology”, the electrocardiogram (ECG), has lead to a lack of basic education on the older technology, the stethoscope. As a result, many heart conditions now go undiagnosed, especially in children and others who rarely undergo an ECG procedure.

Changes May Be Coming To Massachusetts Snow And Ice Rule

Natural vs. Unnatural Accumulation

Massachusetts finally may be seeing a change to its antiquated snow and ice rule. In early February, the Supreme Judicial Court (SJC) heard oral arguments in a case challenging the existing rule regarding property owner liability for injuries caused by snow and ice.

Under current Massachusetts law, a property owner is not liable for any injuries resulting from a “natural,” or untouched, accumulation of snow or ice. A property owner’s liability for injuries resulting from snow or ice only arises once the snow or ice has been altered in some way by human action, or if the snow or ice resulted from human action in the first place, for example ice that forms around a leaking pipe. Accordingly, to prevail in a personal injury lawsuit, an injury victim must prove that the accumulation is unnatural this is very difficult thing to prove.

In Papadopoulos, et al. v. Target Corporation, et al., the plaintiff suffered a hip fracture when he slipped and fell on ice covered by dirt and sand after leaving a Dover Target store. The plaintiff brought suit against the retailer and its landscaper, Weiss Landscaping Company, which had been at the store to clear the ice on the same day as the plaintiff was injured.

At trial, the judge found in favor of Target, arguing that the plaintiff had fallen on a natural accumulation of snow and ice. On appeal, the Appellate Court upheld the lower court’s ruling, agreeing that Target was not liable because the accumulation was natural. The plaintiff then appealed his case to the SJC.

The SJC granted review and directed the parties to present arguments on the following issue: “whether in a premises liability action involving snow and ice, the distinction between natural and unnatural accumulations of snow and ice should continue to be a factor under Massachusetts law.”

Injury Victims Unfairly Punished by Current Rule

The snow and ice rule has been part of the state’s laws for more than 100 years. The law has been subject to serious criticism for its arbitrary and inconsistent application. Many have argued that the state needs to adopt a more current and fair rule, like those used in other snowy New England states. For example, under Connecticut’s snow and ice rule, property owners are given a “reasonable amount of time” after a winter storm to remove snow and ice from their property.

In the appellant’s brief to the SJC, Papadopoulos argued that the current snow and ice rule encourages commercial property owners to allow snow and ice to accumulate on their properties rather than to remove it, creating unsafe conditions for the public.

Indeed, it makes little legal sense to generally require property owners to keep and maintain their property in a reasonably safe manner, but then to allow them an exception to the rule when it comes to snow and ice accumulation. Such an exception to the general rule unfairly punishes injured people, who may suffer serious harm and incur great medical expenses as a consequence of a snow and ice-related injuries .

Those opposed to changing the law argue that the change would unfairly assign liability to property owners. They also argue that property owners still have incentives to remove snow and ice from their premises namely to continue to attract customers to their businesses who otherwise might be deterred by a snowy or icy parking lot or sidewalk.

ConclusionIf the SJC rules in favor of changing the Massachusetts snow and ice rule, the decision would be a large, positive shift for the rights of injured people in the state. Currently, people in Massachusetts rarely pursue premises liability claims related to snow and ice despite suffering serious injuries because these cases are so difficult to win. Changing the law to a more appropriate, modern standard would provide injury victims with a meaningful opportunity to pursue their claims against negligent property owners something the current law denies them.
